Action to recover damages for breach of contract. The plaintiff, Dewey Strong, is a farmer residing in Outagamie county. The
defendant Shawano Canning Co. is a Wisconsin corporation with its principal place of business at Shawano, Wisconsin, and it
is engaged in growing, canning, and marketing certain farm crops. The defendant Shawano Farms, Inc., is a Wisconsin corporation
and during the times material hereto was the agent of the defendant Shawano Canning Co. The defendant Shawano Canning Co.,
by resolution, undertook and agreed to pay debts and obligations incurred by the defendant Shawano Farms, Inc., specifically
guaranteeing payment to producers of farm crops. In April, 1959, the plaintiff entered into a contract, called a lease, with Shawano Farms, Inc. The contract was upon a form
printed and furnished by Shawano Farms, Inc. Under the terms of the contract the plaintiff planted approximated 27 acres of
sweet corn upon his farm. He cared for the crop which grew to maturity fit for canning purposes. At the time of signing a
contract the farmer was given a choice as to whether the sweet corn crop was to be picked by hand or by mechanical pickers
furnished by the defendants. Plaintiff elected to have his crop of sweet corn harvested by means of a mechanical picker, by
the defendants. Only about six acres of his crop were harvested and the mechanical picker was moved to another farm, leaving
21.43 acres unharvested. The damages claimed were because of the failure of the defendants to harvest the crop when it was
suitable for canning.
